General terms and conditions of sale and use

 

Article 1: Scope of application

These general conditions of sale and use apply to all online sales concluded between the customer and Henry Lemoine, as well as contributions made by the customer on the website www.henry-lemoine.com.

Any order placed with Henry Lemoine therefore implies unreserved acceptance by the Customer of these terms and conditions. These general conditions may be modified at any time and without prior notice by Henry Lemoine, the applicable terms being those in force on the date of the order by the customer.

Article 2: Orders

Orders can be placed by the Customer 24 / 24 hours, 7 / 7 days a week, all year round. The descriptions and general technical conditions as they are written on the sales page on the date of the order form an integral part of these GTS and are presumed to have been known and accepted by the Customer at the time the order was placed on the Site. Under no circumstances may a claim or request for reimbursement be made on the basis of ignorance or refusal of these terms and conditions and general technical constraints.

Customers wishing to purchase a Product for sale on the Website must fill in the information requested on the order page for the Product in question.

The Customer may select the method of payment of their choice (credit card via MONETICO (C.I.C. - Crédit Mutuel) or PayPal account) and must accept these GTC by ticking the box "I have read and accept the General Terms and Conditions of Sale (GTC)".

They will then be able to click on the order validation button and will be redirected to a secure page of the site corresponding to the payment method selected.

The data saved by Henry Lemoine is proof of all transactions between Henry Lemoine and its Customer. For online payments, the data registered by the payment system, MONETICO (C.I.C. - Crédit Mutuel) and PayPal, constitute proof of the financial transactions.

In any event, Henry Lemoine reserves the right to refuse or cancel any order from a Customer with whom there is a dispute relating to the payment of a previous order.

All orders paid for online will be confirmed by e-mail to the address indicated by the Customer.

All orders will only be validated once payment has been accepted.

Article 3: Prices

Prices are quoted in euros, including all taxes, but excluding shipping and handling costs (see shipping costs). Prices are subject to change at any time without notice and are payable in full in a single instalment when the order is placed. The products remain the property of Henry Lemoine until full payment has been received.

Article 4: Delivery charges

Orders on the website henry-lemoine.com incur shipping costs. They are calculated according to the weight of the products, the country of delivery and the shipping method chosen. The detailed table of rates can be found on the site under the heading Delivery Method.

These costs are indicated in the order summary when the order is confirmed.

Customs duties or other local taxes or import duties or state taxes may be payable depending on the geographical zone chosen by the Customer. These duties and sums are not the responsibility of Henry Lemoine. They will be borne by the customer and are the customer's sole responsibility both in terms of declarations and payments to the competent authorities and organisations in the country. Henry Lemoine recommends that the customer obtain information on these aspects from the local authorities.

Article 5: Terms of payment

Henry Lemoine reserves the right to suspend any order and any delivery in the event of refusal to authorise payment by bank card or via PayPal by officially accredited organisations or in the event of non-payment.

At the time of payment for the order, the Customer must indicate the card number (16 digits) and the expiry date directly in the area provided for this purpose (entry secured by SSL encryption and sent via the secure credit card payment system, MONETICO of C.I.C. Crédit Mutuel, the only party to receive the bank details issued in this way).

PayPal:

Customers must have a PayPal account to pay for their order using this payment method.

Article 6: Availability 

Henry Lemoine can accept orders while stocks last. 

If, despite Henry Lemoine's vigilance, the products are unavailable, Henry Lemoine will inform the customer by e-mail as soon as possible. The customer may then cancel the order and be reimbursed for the sums already paid.

Henry Lemoine cannot be held responsible for the permanent or temporary unavailability of products, nor can it give rise to any right to compensation or damages for the benefit of the customer.

Article 7: Deliveries

Products are sent to the delivery address indicated by the Customer during the ordering process. The average delivery time is 5 days for France, but this is not a strict deadline and Henry Lemoine cannot be held responsible for late delivery. This period includes the time required to prepare the parcel and the time required for delivery.

Any delays do not entitle the buyer to cancel the sale, reject the goods or claim damages.

Henry Lemoine cannot be held responsible for the consequences of a delay in delivery for which it is not at fault.

The information provided by the Customer when placing an order is binding. In the event of an error in the details of the destination of the order, Henry Lemoine cannot be held responsible for the impossibility of delivering the items.

Henry Lemoine undertakes to keep the Customer informed of the progress of his/her order.

Article 8 : Right of withdrawal and refund

Henry Lemoine undertakes to supply top quality products and also undertakes to reimburse or exchange defective items as soon as possible, provided that they are returned within 15 days, postmarked, in their original packaging. If an item is returned due to an error in the preparation of the order by Henry Lemoine, and only in this specific case, the delivery costs will be reimbursed in full to the Customer.

Cash on delivery is not accepted for any reason whatsoever.

Digital score:

Due to the nature of the purchase, which makes it a non-returnable and multiplyable product, Henry Lemoine will not be able to make any refund, except in exceptional cases such as an unexpected disconnection, a digital partition not loaded in the account, a blocked operating system, an additional credit will be granted to the Customer to repeat the operation. If, however, the problem persists, Henry Lemoine undertakes to refund the item in full. 

For any information or question, the Customer may contact Henry Lemoine (specifying the order number, surname, first name and e-mail address) via the contact form.

Article 9 : Liability

Henry Lemoine's responsibility

The products offered are in compliance with current French legislation. Henry Lemoine declines all responsibility if the article delivered does not comply with the legislation of the country of delivery (censorship, ban on a title or author, etc.). It is your responsibility to check with the local authorities about the possibility of importing or using the products or services you are considering ordering.

Henry Lemoine is not responsible for purchases made on the various streaming platforms on which certain Products may be present and which Henry Lemoine promotes. The Customer must contact the service provider concerned directly for any problem noted during the purchase or subscription on the third party site.

The Customer's responsibility

From the time of delivery, the Customer is responsible for the use of the content presented therein, in particular with regard to any rights and copyright or damage incurred in the personalisation of the Product, Henry Lemoine is not liable for any compensation. The customer undertakes, in a non-limitative manner, to obtain authorisations and to pay for any rights to texts, photos, illustrations and in general to any work that he/she uses. As Henry Lemoine is not responsible for verifying the accuracy of the documents transmitted by the Customer, it cannot be held responsible for any failure by the Customer to comply with the Intellectual Property Code.

The customer is responsible for all risks in the event of loss, theft or destruction of the Product. The customer agrees that Henry Lemoine shall not be liable for any loss of profit, commercial disturbance, fraudulent use, requests or claims made against the customer by any third party whatsoever. Generally speaking, Henry Lemoine may not be held liable for any financial and/or commercial and/or moral prejudice of any kind for any reason whatsoever following the use of a product. 

Article 11: Intellectual property

Under no circumstances is the Customer authorised to download or modify all or part of the Website and in particular its content (products listed, descriptions, images, videos, etc.). Under no circumstances may this Website or any part thereof be reproduced, copied, sold or exploited for commercial purposes without the express written permission of Henry Lemoine.

In general, all copyrights, trademarks and other distinctive signs and property or intellectual property rights appearing on the Website shall remain the full and complete property of Henry Lemoine.

The Customer is therefore bound to respect intellectual property rights and may not use the trademarks appearing on the Site and on the Products, where applicable, or register any trademark that would be prejudicial to the holder of the rights, unless otherwise stipulated in the contract.

Article 12: Personal data

Henry Lemoine handles all information concerning the Customer with the strictest confidentiality. At the time of purchase, only essential information is requested (surname, first name, address, e-mail) for quality processing and careful monitoring of the order. The data entered online is stored on a secure data server.

Use and management of cookies

In order to ensure that the website functions correctly, to measure the audience and to offer a personalised and optimal experience, the website uses cookies which the Customer may or may not accept depending on their type.

Cookies record certain information which is stored in the memory of the hard disk. Under no circumstances do cookies contain confidential information such as name, card number, etc., but they do allow us to remember, for example, the items selected and the pages browsed during previous visits.

Article 13: The right to access and rectify data

Most of the data can be modified directly by the Customer from their customer space on henry-lemoine.com.

In accordance with the French Data Protection Act of 6 January 1978, the Customer has the right to access and rectify data concerning him or her. If they wish to exercise this right, they simply need to contact Henry Lemoine (specifying surname, first name, address and e-mail address) using the contact form or by post at the following address:

Article 14 : Applicable law

All clauses contained in these general terms and conditions of sale, as well as all purchase and sale transactions referred to herein, shall be governed by French law, and the courts shall be those of Paris, the courts of Henry Lemoine's registered office.
