The range of application

This agreement, concerning general sales, applies to all on-line purchases made on the internet site www.henry-lemoine.com between Editions Henry Lemoine and its clients.

Item 2

Orders

The Editions Henry Lemoine reserves the right to cancel any order made by a client with whom there exists a legal dispute concerning the payment of a previous order.
When you click on the Validate button at the end the ordering procedure, you declare to have fully accepted, without reserve, all of the general sales conditions.
The data recorded by The Editions Henry Lemoine serves as proof of all of the transactions between The Editions Henry Lemoine and the client. For on-line payment, the data recorded by the payment system, CYBERMUT (C.I.C. - Crédit Mutuel), serves as proof of all financial transactions.
All orders paid for on-line will be confirmed by e-mail at the address provided by the client.

Prices

All prices are given in euros, and include taxes, as well as shipping and handling charges (see shipping costs). Prices can be changed at any time without warning. They are due in their totality in a single payment when an order is placed. The products remain property of Editions Henry Lemoine until they have been completely paid for.

Shipping costs

Orders placed on the henry-lemoine.com site entail shipping charges. They are calculated according to product weight, country of destination, and the rate chosen from the following chart.
These charges are indicated in the order summary upon validation.
Duties or other local taxes, import fees, or state taxes may be payable depending on the geographic zone that you have chosen. These charges and fees are not the responsibility of Editions Henry Lemoine. All declarations and payments to the corresponding authorities and organisations are the purchaser's full responsibility. We advise you ask for information about these issues from your local authorities.

The client acknowledges being fully informed about the shipping and handling costs that are in addition to the price of the ordered articles.

Item 5

Payment

Editions Henry Lemoine reserves the right to block the processing of any account and all deliveries in the case of refused credit card payment authorisation by the officially accredited organisms, or in the case of non-payment.

The price is immediately due for payment on the order date. Purchases can be paid for in the following ways :

By credit card on line.

When ordering, you must indicate your credit card number (16 numbers) and its expiration date, directly in the appropriate space (secured by SSL encryption and sent via our secured credit card payment system to the C.I.C. Cybermut, Crédit Mutuel, which will alone receive the banking information being sent).

By credit card using a fax.

When ordering, you must indicate your credit card number (16 numbers) and expiration date, directly in the appropriate space on the order form, that can then be printed and faxed to us at 33 (0) 1 56 68 90 66.

By cheque made out in euros,

acceptable by a French bank. The cheque must be made out to Hexamusic, accompanied by the printed order form, and sent to the following address :

The cheque will be deposited when the order is filled. Payment for on-line printed scores is made exclusively by credit card.

Item 6

Availability

If all or part of an order is unavailable, Hexamusic will provide reimbursement by cheque.

Item 7

Delivery

The products will be sent to the delivery address that you provided when ordering. For France, the average delay is 5 days, but this is not a strict time limit and Editions Henry Lemoine cannot be held responsible for late delivery. This delivery time includes the time required to prepare and transport the package.
In case of late delivery, the buyer does not have the right to cancel the sale, to refuse the merchandise, or to claim damages.
Attention : if you choose to pay by check, the order will be processed when it is received and as a result the delivery time will be longer. The information provided by the client, when ordering, is binding. In the case of an error when transmitting a receiving address, Editions Henry Lemoine will not be held liable if they are unable to deliver the articles.

Item 8

Quality

Editions Henry Lemoine is committed to providing you with high quality products, and agrees to reimburse you or to exchange defective or non-conforming articles as quickly as possible, so long as the articles are returned to us in their original packaging within 15 days (as determined by the postmark). If an article must be returned as a result of an error on our part, the delivery charges will be reimbursed in their entirety.
No COD shipments will be accepted, regardless of the reason.
In the case of transfer failure of on-line printed scores due to a temporary breakdown (unexpected disconnection, printer malfunction, blocked operating system), a supplemental credit will be given so that the operation can be renewed. However, if the problem persists, we agree to reimburse the article completely. For all complaints, please write to the webmaster@editions-lemoine.fr, specifying the transaction number, which we provided to you during payment.

Access rights and rectification

With all due respect to protecting your private life, Editions Henry Lemoine treats all information concerning you with the strictest confidentiality. When you make a purchase, we ask only for the information that is indispensable (name, family name, address, e-mail) to provide quality processing, and careful follow-through on your order. All data registered on-line is recorded on a secured server.

Item 10

Liability

The proposed products meet the requirements of currently applicable French law. Editions Henry Lemoine declines all liability if an article that has been delivered does not respect the laws of the country to which it has been delivered (censure, prohibited authors or titles...). It is your responsibility to verify what can be imported with the local authorities, as well as how the products or services that you are considering ordering can be used.
The photographs and texts that are reproduced to illustrate the proposed products are not binding. As a result, Editions Henry Lemoine cannot be held liable in the case of an error in one of these texts or photographs.
Editions Henry Lemoine will not be held responsible for not honouring the agreed-upon contract in the case of absolute necessity (force majeur), the disruption due to a partial or total strike in particular of the postal services and other transportation and/or communication systems, flooding, or fire.
Editions Henry Lemoine declines all responsibility with regards to the content of sites reached by hypertext links from its own site.

Applicable law

French law applies to all of the clauses included in this general sales agreement, as well as to all purchasing operations, the corresponding courts will be those of Paris, that of the registered office of Editions Henry Lemoine.
